I caught up with a number of attorneys at Sanders & Parks yesterday. The firm has had a number of major trial successes lately. One recent favorable ruling, attained by attorney Mark Worischeck and Debora L. Verdier, is particularly noteworthy.In Maricopa County Superior Court, Mark won a possible precedent setting ruling for his client, SCF Arizona. The new court ruling will keep costs down for workers' compensation insurance companies and the businesses that carry workers compensation coverage.
The Judge ruled that the State Compensation Fund does not have to pay the full-bill charges for
services provided at ambulatory-care centers for employees who are injured. The evidence supplied by Sanders and Parks showed that the care centers were not charging a reasonable value for their services. Workers' comp carriers like SCF cannot dictate where injured workers go to seek treatment. Apparently this led to some care centers to take advantage, charging much more for services than they normally would. The new ruling means that WCF does not have to pay unreasonable medical bills.
